Core Eligibility Criteria
To be eligible for the Subclass 491 visa, applicants must meet several stringent requirements:
- Invitation to Apply: You cannot apply for this visa without a formal invitation from the Department of Home Affairs. This requires submitting an Expression of Interest (EOI) via SkillSelect.
- Nomination or Sponsorship: You must be nominated by an Australian state or territory government agency, or be sponsored by an eligible relative residing in a designated regional area.
- Occupation List: Your nominated occupation must be on the relevant skilled occupation list, and you must obtain a valid Skills Assessment from the authorized assessing body.
- Age: You must be under 45 years of age at the time of the invitation.
- English Proficiency: You must demonstrate “Competent English” (e.g., an IELTS score of at least 6 in each component or equivalent).
- Points Test: You must achieve a minimum score of 65 points on the points test, which includes the 15 points granted by the state/territory nomination or family sponsorship.
The Regional Definition
“Regional Australia” for the purposes of this visa includes almost all of Australia except for Sydney, Melbourne, and Brisbane. This means major cities like Perth, Adelaide, the Gold Coast, and Canberra are currently classified as regional, offering a high quality of life and diverse employment opportunities.
Rights and Obligations
The Subclass 491 visa is valid for five years. While it is a provisional visa, it offers many of the same benefits as permanent residency, including:
- Work and Study Rights: Holders can work in any occupation and study at regional institutions.
- Medicare Access: Unlike many other provisional visas, Subclass 491 holders are eligible to enroll in Medicare, Australia’s public healthcare scheme.
- Travel: You can travel to and from Australia as many times as you want while the visa is valid.
Condition 8579: This is the most critical obligation. It mandates that the visa holder (and their family) must live, work, and study only in a designated regional area. Failure to comply with this condition can lead to visa cancellation.
Pathway to Permanent Residency (Subclass 191)
The Subclass 491 visa is a direct stepping stone to the Permanent Residence (Skilled Regional) visa (Subclass 191). To transition to permanent residency, you must:
- Hold a regional provisional visa (like the 491) for at least three years.
- Show that you have lived, worked, or studied in a regional area for those three years.
- Comply with all conditions of your provisional visa.
